Introduction
The European Commission (hereafter ‘the Commission’) is committed to protect your personal data and to respect your privacy. The Commission collects and further processes personal data pursuant to Regulation (EU) 2018/1725 of the European Parliament and of the Council of 23 October 2018 on the protection of natural persons with regard to the processing of personal data by the Union institutions, bodies, offices and agencies and on the free movement of such data (repealing Regulation (EC) No 45/2001).
This privacy statement explains the reason for the processing of your personal data, the way we collect, handle and ensure protection of all personal data provided, how that information is used and what rights you have in relation to your personal data. It also specifies the contact details of the responsible Data Controller with whom you may exercise your rights, the Data Protection Officer and the European Data Protection Supervisor.
The information in relation to processing under Erasmus+, Creative Europe and European Solidarity Corps Project Results Platforms (E+/CE/ESC PRP) undertaken by DG EAC.A3 is presented below.
Why and how do we process your personal data?
The Erasmus +, Creative Europe and European Solidarity Corps Project Results Platforms (E+/CE/ESC PRP) are the electronic platforms for the dissemination and exploitation of results of projects funded by the Directorate-General for Education, Youth, Sport and Culture (DG EAC) of the European Commission.
The purpose of the processing is to offer a comprehensive overview of all projects funded under the Erasmus+, Creative Europe and European Solidarity Corps programmes, their beneficiaries and their results. Project results are mandatory for Erasmus+ KA2 projects and strongly recommended for other projects.
The specific purpose of the Project Results Platform (PRP) is to disseminate the results of the above mentioned programmes and offer networking opportunities to interested third parties. To achieve a possible communication with the organisations implementing the projects, processing of certain categories of personal data (along other non-personal, project data) is needed.
Grant Management Systems, e-Grant (EACEA) and PMM (EAC) upload the published information which may include personal data into E+/CE/ESC PRP. Some of the projects funded under the previous generation of programmes are still uploaded from YouthLink, ADAM, EST. Pegasus and E+Link. The information is previously validated by EACEA and National Agency project officers. Additional personal data of contact persons can be manually provided for E+ and CE projects by the project coordinator (beneficiary) and will be published only after an explicit "opt-in" action carried out by the beneficiary organisation obtaining the containing the consent of the data subjects.
Your personal data will not be used for an automated decision-making including profiling.
On what legal ground(s) do we process your personal data?
The Project results platforms offer a comprehensive overview of all projects funded under the Erasmus+, Creative Europe and European Solidarity Corps programmes as well as of some projects funded under the previous programmes (i.e Life Long Learning, Youth in Action, Culture).
The relevant legal bases for the establishment of the Project Results Platform are:
- Regulation (EU) 2021/817 of the European Parliament and of the Council of 20 May 2021 establishing Erasmus+: the Union Programme for education and training, youth and sport and repealing Regulation (EU) No 1288/2013;
- Regulation (EU) 2021/818 of the European Parliament and of the Council of 20 May 2021 establishing the Creative Europe Programme (2021 to 2027) and repealing Regulation (EU) No 1295/2013;
- Regulation (EU) 2021/888 of the European Parliament and of the Council of 20 May 2021 establishing the European Solidarity Corps Programme and repealing Regulations (EU) 2018/1475 and (EU) No 375/2014.
We process your personal data, because:
The data subject has given consent to the processing of his or her personal data in the Project Results Platform for one or more specific purposes. Data subjects express their consent – to the project beneficiary – for uploading personal information (such as photos of the data subject) on the platform and by explicitly agreeing on certain personal data to be displayed publicly (i.e. name, surname, email of the contact person).
Which personal data do we collect and further process?
In order to carry out this processing operation DG EAC.A3 collects information about the projects, such as:
- Personal data of contact person(s) in the coordinating and partner organizations: name, first name, phone numbers and e-mail address.
- In case of beneficiaries who are represented by a natural person, the full name of the project coordinator or partner (personal data) will replace the name of the organisation.
The provision of personal data is not mandatory, but it might be required to provide additional information to the user (i.e. to contact a specific person in the beneficiary organisation). The data controller doesn’t request beneficiaries to upload any personal data (of participants, staff etc) under the project results uploaded manually by them on the platform. However, if they consider such personal data as relevant for the purpose of better disseminating the results of the project, they should do it in full compliance with the data protection obligations applicable to them and be able to prove upon request the existence of consent expressed by all data subjects whose personal data are submitted for publication.
We have obtained your personal data from the beneficiary according to the provisions set in the grant agreement. For the manually uploaded personal data, the consent will be given by the data subjects but will be gathered by the beneficiary organisations.
How long do we keep your personal data?
DG EAC.A3 only keeps your personal data for the time necessary to fulfil the purpose of collection or further processing, namely for ten years after the end of the final publication of the project mentioned under point 3, i.e. Lifelong Learning, Youth in Action, Culture, Tempus, Erasmus Mundus, Creative Europe and Erasmus+.
How do we protect and safeguard your personal data?
All personal data in electronic format (e-mails, documents, databases, uploaded batches of data, etc.) are stored on the servers of the European Commission. All processing operations are carried out pursuant to the Commission Decision (EU, Euratom) 2017/46 of 10 January 2017 on the security of communication and information systems in the European Commission.
In order to protect your personal data, the Commission has put in place a number of technical and organisational measures in place. Technical measures include appropriate actions to address online security, risk of data loss, alteration of data or unauthorised access, taking into consideration the risk presented by the processing and the nature of the personal data being processed. Organisational measures include restricting access to the personal data solely to authorised persons with a legitimate need to know for the purposes of this processing operation.
Who has access to your personal data and to whom is it disclosed?
Access to your personal data is provided to the Commission staff responsible for carrying out this processing operation and to authorised staff according to the “need to know” principle. Such staff abide by statutory, and when required, additional confidentiality agreements.
The information about the projects is processed by the E+/CE/ESC PRP system supplier (EAC.R4) and E+/CE/ESC PRP helpdesk staff (EAC.A3). The information is transferred automatically from the Grant Management Systems (e-Grants/EACEA and PMM/EAC) into E+/CE/ESC PRP for publication.
The information about the project results is processed and validated by Project officers (National Agencies and EACEA) before publication. The information is uploaded by the project beneficiaries directly into E+/CE PRP. This feature is currently not available for ESC PRP.
What are your rights and how can you exercise them?
You have specific rights as a ‘data subject’ under Chapter III (Articles 14-25) of Regulation (EU) 2018/1725, in particular the right to access, your personal data and to rectify them in case your personal data are inaccurate or incomplete. Where applicable, you have the right to erase your personal data, to restrict the processing of your personal data, to object to the processing, and the right to data portability.
You have consented to provide your personal data for the present processing operation. You can withdraw your consent at any time by notifying the Data Controller. The withdrawal will not affect the lawfulness of the processing carried out before you have withdrawn the consent. In addition, you can exercise your rights by contacting the Data Controller, or in case of conflict the Data Protection Officer. If necessary, you can also address the European Data Protection Supervisor. Their contact information is given under Heading 9 below.
